1In short
Portfoli.au keeps records. It does not give advice.
We are not licensed to give you financial product advice and we are not registered to give you tax advice. Everything the service shows you is general information produced from data you or your connected accounts supplied.
It does not take account of your objectives, financial situation or needs. Before you act on it, speak to a licensed financial adviser or a registered tax agent, and check the figures against your own statements.
2We do not provide financial product advice
[Registered company name] Pty Ltd does not hold an Australian Financial Services Licence and is not an authorised representative of a licensee.
Nothing in the service is financial product advice as defined in section 766B of the Corporations Act 2001 (Cth). Nothing in it is a recommendation, statement of opinion or report that is intended to influence you in making a decision about a financial product, and nothing in it should be taken as suggesting that any investment is appropriate for you.
In particular, the service does not:
- recommend that you buy, hold or sell any financial product;
- assess whether an investment or strategy suits your circumstances;
- provide a Product Disclosure Statement, Statement of Advice or Financial Services Guide; or
- arrange for you to deal in a financial product, or deal on your behalf.
Charts, allocations, returns and analytics in the service describe what you have recorded. They are descriptive, not advisory.
3We do not provide tax agent services
[Registered company name] Pty Ltd is not a registered tax agent or BAS agent under the Tax Agent Services Act 2009 (Cth), and does not provide tax agent services as that Act defines them.
The service calculates figures that are relevant to Australian tax, including cost base, capital gains and losses, the CGT discount, franking credits and distribution components. Those calculations apply general rules to the data available. They are a starting point for a conversation with your tax agent, not a substitute for one.
Your circumstances change the answer. Whether a CGT discount applies, which shares are counted as sold, how a trust distribution is characterised, whether a holding is on capital or revenue account, whether you are a tax resident, and how an SMSF is treated all depend on facts the service does not know.
You are responsible for what you lodge with the Australian Taxation Office. Have a registered tax agent review your position before you lodge. You can check whether a person is registered on the Tax Practitioners Board (TPB) register at https://www.tpb.gov.au.
4General information only
Any general information the service provides has been prepared without taking account of your objectives, financial situation or needs. Because of that, you should consider whether it is appropriate for you, having regard to those things, before acting on it.
Where information relates to a particular financial product, you should obtain and read the Product Disclosure Statement and Target Market Determination for that product before making a decision about it.
5Figures are estimates and must be verified
The service works from the records you enter, the records your connected accounts return, and third party market data. Any of those can be incomplete, delayed or wrong.
Figures commonly go out of date or out of step because of:
- corporate actions, such as share splits, consolidations, mergers, demergers, returns of capital, rights issues and buy-backs;
- dividend reinvestment plans and stapled securities;
- off-market transfers, inheritances and in-specie contributions;
- broker exports that omit brokerage, or that report in a different currency or on a different date convention;
- foreign exchange rates and the date on which they are applied; and
- trades made outside any connected account.
Check what the service shows against your broker confirmations, holdings statements and dividend statements before relying on it. Where they differ, your source documents are the record, not the service.
6Market data
Prices and market data in the service may be delayed, may be sourced from third parties, and are provided for information only. They are not live quotations, not an offer or invitation to transact, and not a representation that a price is available to you.
Valuations are only a guide. The amount you would actually get from a sale depends on the market at the time, how many units you sell, brokerage and the gap between buying and selling prices.
7Past performance
Past performance is not a reliable indicator of future performance. The value of investments rises and falls, returns are not guaranteed, and you may get back less than you invested.
Return figures in the service describe what has happened to what you have recorded. They are not a forecast and they are not a promise.
8Self managed superannuation funds
Where you use the service for an SMSF, the trustees remain solely responsible for the fund’s compliance with the Superannuation Industry (Supervision) Act 1993 (Cth), its regulations, the fund’s trust deed and its investment strategy.
The service does not audit the fund, does not determine whether an investment is permitted, does not assess the in-house asset rules, the sole purpose test, contribution caps or pension standards, and does not prepare or lodge the fund’s annual return. An SMSF must be audited each year by an approved SMSF auditor.
9Third party content and links
The service may contain links to, or information from, third parties. We do not endorse them and we are not responsible for their content, accuracy or availability. Any dealings you have with a third party are between you and that third party.
